Casework MethodThe Six-Step Crypto Recovery Framework

The Six-Step Crypto Recovery Framework

framework

Core idea

Tracing and recovering are different jobs with different clocks. A trace can take weeks and still be useful. A recovery has a window measured in hours, and it runs several workstreams at once rather than in sequence. This is the recovery arc: six steps that start before the trace is finished and keep running long after the freeze lands.

Components

  1. Rapid response. Objective: freezing orders and preservation notices inside 24 hours of discovery. Scope the loss, set up monitoring, and file in the priority jurisdictions before the analysis is complete.
  2. Evidence preservation. Objective: lock down technical and financial evidence before it degrades or is destroyed. Node snapshots, chain-state exports with pre-incident and post-incident balances, authentication logs, exchange interaction records.
  3. Parallel legal strategies. Objective: run civil, criminal, regulatory, and contractual avenues simultaneously rather than one after another, so each applies pressure from a different angle.
  4. Targeting choke points. Objective: apply pressure where the stolen value must pass through centralised control. Exchanges, OTC desks, bridges, stablecoin issuers.
  5. Establishing a fusion cell. Objective: one integrated team (counsel, forensic analyst, local counsel, technical expert, client) with a single decision authority and a defined operational tempo.
  6. Post-seizure monitoring. Objective: keep watching after the freeze, because a freeze invites circumvention rather than ending the case.

When to use

At the opening of any live theft where recovery, not just attribution, is the goal. Steps 1 through 4 overlap heavily in the first days; treating them as a sequence is the single most common way a recovery fails.

Avoid when

Do not import this wholesale into a pure attribution or intelligence case. Most of the framework exists to serve a legal action, and without a client willing to fund filings, steps 3 through 6 have nothing to attach to.

Example

A theft is discovered at 09:00. Monitoring and alerting go up within the hour while counsel drafts ex parte freeze applications from templates, the forensic analyst produces an initial trace for the evidence pack, and preservation letters go to the exchanges in the likely off-ramp path. None of those waits for the others to finish.
